In cases where the punishment that is necessary
for the principal offence exceeds not what is produced by the obligation to burthen of
satisfaction
make amends, none at all is required for any
preliminary offence; in other words there is no need
for the establishment of to establish any such offence. This is
the case for instance with those offences against property which
are committed without mala fides upon supposition
of a title. Even were the principal offence committed
there would be no secondary mischief in the
case; no alarm spread through raised in the community:
and as the principal offence is not committed, [neither
is there any] the primary mischief is in like
manner wanting.
