§ Evidence
this is one of the points to which the penitus toto
divisos orbe Britannos may be applied. At some
future time I shall have occasion to enquire
[fully and] at large which is most in the right in
these particulars, Great Britain or all the world
besides? How far the [rules of the] British English law in these as to these
points respects is consistent with the purposes of justice? how
far it is consistent with itself? whether the exped
exceptions which are admitted of are to be justified on
any other principles than what militate equally against
the rule? How far they are grounded in
humanity? whether the utility [that has resulted belongs to them]
they are of consists in any thing else than the inefficacy they
have given to such certain inexpedient laws, in
particular to such in particular of which the tendency
is to vest an arbitrary power in the crown? and
whether the use that utility they are of would be better compassed
by retaining of the rules, or by placing those inexpedient
laws upon a better footing. This
These delicate and important questions I hope
hereafter I may to discuss at large [upon paper
as I have long done in my own mind] All I
shall observe here is, that these precautions if not
necessary for the protection of innocence, can are evidently not
but be most powerful causes of uncertainty with
regard to those punishments that are calculated for
the prevention of guilt delinquency : are evidently most
powerful screens to
