Prosecutor
delay gives room for incidents which breed fresh
delay. A chain of operations must be carried on:
which chain to prevent that there may be no confusion or nor neglect, there
must be some one person to conduct. Hence
another function that of prosecution takes its rise:
with this difference in such sort however which prosecutor may either
be one of the witnesses or any other person

of the Judge which is to be fished for

accident or design has been split into divers functions
to be carried on performed at different times by different
sorts of persons: the Judge who receives the evidence
while it is fresh is not permitted to decide upon
it, be it ever so clear, but to must send it off to another
Judge
