The utility of this institution is founded upon one
or other of two suppositions: that the persons [thus
made vicariously responsible] thus charged were parties
to the criminal design: or that not being parties
to it, but having it finding it subsequently in their power to ob prevent it
or to stop it or to bring the parties concerned in it apprehend the parties, or to give furnish information
