I shall not reject any of those frequent occasions opportunities that
will occur of pointing out the imperfections both
in theory and in practise of our ancient Law and those who executed it
[tis from a first accurate observation of those imperfections that we are taught that lesson which some are so unwilling to learn, how much reason we have to be pleased satisfied with those amongst whom & under whom we live.] [it's executors and professors tis from an accurate view of the inconveniences
of each preceding period that we discover how
much reason we have to be pleased with those
with whom and under whom we live.]

I cannot so well am not so sensible of the use of that profound mysterious
reverence for antiquity which writers upon this
subject in particular are so prone to entertain
and so studious to inculcate propagate.

English Jurisprudence

Is our System of Criminal Law a good one?
Yes and no. Yes, if compared with that of itself
in former preceding ages. Yes, if compared with that
of other nations in all ages which come nearest to a competition there are two sorts of persons who shelter themselves under this error; those even by the confession
of those nations themselves

No if compared with our Idea+ + I speak not of visionary but of attainable perfection. [of attainable such as is 3 4 5

Thus it happens in this as in so many other
cases of The Law is so 1 uninviting 2 a study, that the people chuse a better intent rather to give credit to the its pictures of it Professors for that high excellency made by it's Professors which they arrogate to it than to be at the price of examining their foundation it's good [meaning here nothing absolutely positive, but being] being a term of comparison, that
two men with the same Sentiments may use different
languages concerning it, owing to their assuming
different standards of [that] comparison —
neither is a [single] writer therefore inconsistent who
in one minute be found exulting exult in the excellence of the same
System and when in the next he deplores it's imperfection.
