And this Defendant saith that if within the term comprized
in their said agreement and stated in this defendant's said letter it
had turned out that for the necessary repair of the said Houses or
any of them the Complainant had incurred any loss or damage
viz: had bonâ fide expended thereon any sums exceeding the
difference between the said £36 or there abouts sum so allowed
to him in abatement as aforesaid this Defendant would upon
his the Complainants resigning the premises as he ought to have done at the expiration of the said term
have been ready and willing to have made good to him the
same. And this Defendant upon the Defendants Complainants
producing good and sufficient evidence to prove his having laid out
of his own money upon the whole of the premises comprized in the said lease together during the same term any sum exceeding
the profit made by the same would even now be ready
and willing and hereby offer to make good to him such
difference. But this Defendant honestly asserts that by the of the said agreement the Complainant is not nor
ever has been entitled to any such compensation in Law or
Equity, and not being entitled thereto nor having ever so
much as made any application to this Defendant for the same
the Complainant had not nor hath just cause or so much
as colour for putting this Defendant to any expence on
that score by this his Bill or otherwise and this
Defendant humbly submitts to Your Honour in what person
other than this Defendant the costs of this said Bill in that
behalf ought to fall.
