I lay aside as a most useless and mischievous
institution as it stands on the footing it stands upon in England at present in its
present footing, that of Grand Juries.
It is useless because being design the pretended
use of it being to prevent vexation it is no
bar to vexation in the cases where vexation is
infinitely the most grievous and the most to be
apprehended.
It is of no use in mos offences short of
felony, because frustrated rendered of no effect in their cases by informations
and attachments. It particular it is
for that reason of no use in the case of libels
as a safeguard in the quality of to the liberty of the press.
It is of no use in offences of the rank of this
felony, because in those instances + + it never is or can be applied late after the mischief
which it pretends to obviate is incurred before
