2. In the case of a Colony acquired any other way
than by conquest and in particular in the case of all
English Colonies at that time in existence the right of
legislation in the Crown alone is disaffirmed: and a
in such the affair through under the condition of if being
exercised with the consent of an Assembly of the
Colony it is affirmed
the right of the Crown to legislate
without express authority for that purpose from Parliament appears to be
affirmed: yet the such affirmance is neither very distinct
nor direct: and appears to have had for its ground
no other than the prima facie right derived from undisputed
usage.

For the proof of this, I trust to the words of the opinion
in question as given above:
