Why if the offender for the space of [half a year] contrives unable to undergo
the ordinary punishment it may be
mitigated?

Reasons

1. In consideration of the great anxiety he must
have been undergoing all that time on account
of the uncertainty of his fate: which anxiety
ought to be taken into the account of his punishment,
and when added to the mitigated punishment
may have equal to the ordinary.
