comes every act of proposal instigation instruction or assistance which

2 Punishment for attempts
From p. 14 <add>6. No 1.</add> An Attempts which fails without any change in
the intention of the offender, as for instance where
the failure he supposes it the attempt to have already succeeded,
or success to have become physically impracticable,
shall be punished receive punishment as if they it had succeeded, as to
every article except such part as is made proportionable
to the quantity of the damage.

Extenuation I Repentance
Where the offender having it yet in his power
to present prosecute the attempt with a prospect
of success, desists through sorrow for which he has done the part he has taken
and not merely through the fear of punishment.
In such case the Judge may remit the a part
