Under what title this should be done.
This done it will remain to be consider'd which of
two plans will be most convenient, to insert every thing
that relates to attempts and preparations under the
title of necessary offences, or to distribute the matter
under the heads of the several consummated offences
to which they respectively relate.

Whether the distinction between attempts and preparations is worth preserving.
It is to be observed that all this trouble might
be saved, only by only obliterating the distinction
between attempts and preparations. The effect of this
will only be the taking away the peremptory obligation
above established in the former case, and committing making
the punishment to depend equally in both cases upon
the discretion of the Judge. See the Questions at the
end of this title. To p. 5. No 2.
