Question IV.

Why in case of divers attempts or preparations offences of the same train
the punishments is are not to be accumulated?

Reasons

Because if it were otherwise, the punishment for
a bare preparation even without attempt might exceed
the punishment for the prepara actual perpetration.+ + See Quest. II. supra In By offences
of the same train, although there should be fifty of them
there is but one evil produced, one event intrinsically
obnoxious. Offence Such as are subsequent precede
that event, indicate the probability of it's having been
about to happen; such as are subsequent to it, the
probability of it's having happened.
