Whether the striker ought to be punished more than the hirer
It has been said that in certain offences (which seem
to have been all that on that occasion were in view
view) to wit in homicide, it would be of use to punish
in a severer manner him who strikes the fatal
blow, than him one who hires him. The reason given is
that this will make it more difficult to find a man who
to give the stroke, and be a germ of dissention among
the malefactors confederates, by making it a matter
of debate among them who shall thus expose
himself.
In answer to this it may is to be observed that the
offender thus circumstanced is neither the not in either of the two senses
above laid down, the principal: neither by priority
of intention nor by peculiarity of situation. [nor
