2 A justification applying to the instigator appl extends to the perpetrator as to all but cautionation.
If the instigator be a man under a circumstance
of justification instigate another to perpetrate what
would otherwise be an offence, and the instigatee
perpetrate it accordingly not knowing of the justification he shall not be pre criminally
responsible, although he knew not of the justification

An exemption applying to the instigator extends not to the perpetrator
If a man person exempted from punishment by
reason of physical compulsion insanity or infancy, instigate
another to perpetrate an offence, and the offence
is committed accordingly, the instigatee shall not have
the benefit of the exemption.
