§. XI. How to estimate pecuniary ability.

Method of estimating a man's pecuniary ability.
To take an estimate of the pecuniary ability of
a party, proceed as follows:
1. Take an account of the enabling circumstances belonging
to his Fortune.
2. Take an account of his disenabling circumstances attending
it.
3. Strike the balance; which if on the enabling side, gives
the clear amount of his pecuniary ability.

1. His enabling Circumstances.
Among his enabling circumstances are to be reckoned
the following.
1. The present value of His capital; whatsoever it consists in: including land
and other immoveables, furniture, stock in trade, money
out at interest, and so forth; and whether in possession,
certain expectancy, or contingency.
2. The growing profits of his labour, upon an average taken
for such a time back, as seems most likely to exhibit a
due medium.
