2. If it appear that he was not able to take any steps
for that purpose by reason of his being under unlawful
confinement, or such a degree of ill health as prevented
him from taking any care of his affairs, or absence in a
foreign country.

3. If it appear that he was induced to let slip the time
by any contrivance employed by or in behalf of the other party.
4. Accident.
4. If it appear that he took measures for prosecuting presenting in
due time, and the time elapsed without any fault of his
own, by the default of some person employed in his behalf.
For the measures to be taken for putting be put in a claim to
compensation notwithstanding the author of the damage is
unknown or absent and for renewing the same from time
