§. XIII. In what Shapes Compensation
may be bestowed.
1.
Compensation may be given either in the shape of by a capital
Sum or by of a periodical allowance; and in the latter case
either for a term certain or for life or lives: and in either case subject
to be determined or diminished or increased upon contingencies
according to the discretion of the Judge; and it
may be allotted out of a precarious fund such as the
profits of day labour, as well as out of an assured one.
Example

An annuity for life may be proper for instance where
the damage is of such a nature as to render a man unable
or less able to get his livelyhood; and it may be proper
to make it cease upon the event of his acquiring a provision
to such or such an amount from another quarter;
or upon the damnifier's becoming less able to endure the
charge.
