7. C Of Compensation
Cases that have the 3d best Claim to Compensation.
Claim to compensation. Another set of Cases are those in which
the loss or inconvenience of the party damnified is not pecuniary
or quasi-pecuniary, and the author of the damage receives a profit
or advantage which is not pecuniary nor quasi-pecuniary
Damage not pecuniary,profit not pecuniary.
neither: but of the vindictive or malevolent kind. These Cases
occupy the third rank among those which afford a claim to
compensation.

Example
Cases of this sort are mostly those where the offence is
a personal injury, circumstanced as such offences are in common.

Cases that have the 4th best claim to Compensation. Damage pecuniary Profit none
Another set of Cases are those in which the loss or
inconvenience of the party damnified is pecuniary or quasi-
pecuniary, but the author of the damage receives no profit whatsoever.
These Cases occupy the fourth rank among those which
afford a claim to compenation.

Example.
Cases of this sort are those in which damage happens
to a man's property in consequence of an act or neglect, which
being unintentional with respect to the damage, or proceeding
upon a mis-supposal is no offence unless it be in the case of
heedlessness.
