11 C Of Compensation
a coat which he bought new and has half-worn, it is not enough on
the score of simple restitution to give him as much money as a half-worn
coat of the same sort is to be bought for: he ought to have
as much given him as will enable him to buy a new one. For
1. It is not so agreeable nor so reputable to a man to have a
coat that has been already worn by another person as a coat
that has been worn by himself in the same degree. 2. He cannot
be sure of meeting with a second-hand one that will fit
him. 3. It may not suit him at that time to advance the
difference and buy a new one.

So if the coat be not lost or destroyed, but only damaged; if
it be damaged that according to the customs of the country it can
no longer be reputably worn, by a person of the owner's condition,
let him on the score of simple restitution receive the price of a new
one; the author of the damage being at liberty to take the old one
if he pleases.

Consequential damage to be taken into account.
Let consequential damage, how remote soever, as well as
what is direct and immediate be taken into the account. For as far
as the circumstances of the parties admit every particle of the damage one
