17. C Of Compensation
1. Damage produced without blame how to be shared between a single Author and a single party damnified.
damage, and one party damnified, and there is no blame whatever imputable
to the author of the damage, nor is he in any of the cases,
in which he is held particularly responsible, let the burthen of the
damage be divided between him and the party damnified, according
to their pecuniary circumstances. Thus if those of the author
of the damage be twice as good as those of the party endamaged,
let the former make amends for two thirds of the damage, and
the latter bear the remaining third without amends.
2. Where there are several parties damnified.

If by the same act (an act, for instance, whereby a number
of persons are burnt) several parties be endamaged, let the Author's
proportion of the burthen be as his ability is to the sum of
theirs. Thus if there be two such parties, and his ability be twice
as great as that of either of them, instead of bearing two thirds of
the damage sustained by each of them, let him bear but half of
that sustained by each.
3. Where the party damnified is the Public.
