§ect XIV.
§. XIV. Compensation survives the Parties.
1.
In case of the death of a party damnified (A) the right of receiving
compensation descends to his representatives.
Exposition.
[(A) Damnified] It matters not of what nature is the damage; whether
it affect a man in his person, in his property, in his reputation, or in
his condition.
Reasons.
1. The contrary institution has no advantages.
1. There are no advantages that can accrue from the not extending
it to such persons; the following are the inconveniencies.
2. It would be a hardship to the representative.
2. It is a hardship, a disappointment, to the representative: the
same hardship, the same disappointment as it would have been to
the party damnified to have seen his right taken from him by
any other unexpected event. When compensation is provided by the
Law for the party damnified, no sooner is the damage known
than it brings to view the right which he has to compensation; and
that not to his view only, but to that of any person who thinks himself likely
