In considering the several material subjects
of property treat 1. of simple subjects. 2. of
subjects naturally associated; as produce of land
with the land. 3. of subjects artificially conjoined
as the effects of a partnership or the effects of an
inheritance.
Of Contracts – on the several sorts of obligations
arising from express stipulation.
Of incidental obligations – or the several
sorts of obligations liable to result from the
several sorts of express stipulations: such as repairs
from hire.
Powers – Qu. would not powers serve
better as a genus generalissimus for preponderance than Property – Property being
very naturally reducible to the notion of Power very beneficial over
things: but at the same time that public fiduciary
powers over persons are not without violence
reducible to the notion of property.
