[I would not take upon me without a very
particular study of the subject to pronounce
whether] could an institution any way resembling that
of juries in England could or could not with
any prospect of advantage be established in
favour of the natives by under the government of
the English in [Company] Bengal ..? th + + This is a question in which without a very particular study of the subject I would not take upon me to pronounce. But this much I
would take upon me to say that it could
not without very considerable deviations from
the form in which it subsists in England.
The following may serve as a loose and imperfect
sketch of them.
In England, a man has unless by accident
nothing at all to fear and never much to fear, from the consequences
of his verdict: in Bengal a native would have, or
what would come to the same thing be much at one would fancied
he had, every thing , to fear. — [Is it possible
to reconcile the independency to courage of mind which is
necessary to [ensure] the justice of his the verdict
with the subjection which is necessary to ensure
his allegiance to the government? To give
a decided answer to this question is more than I would could take undertake without a very close and careful examination of this particular subject.]
