same religion If they be it should be a Mahometan and

religions; determining by lot which religion
shall have the odd one, or taking for the odd

If an European and a Mahometan, or
an European and a Gentoo, the turn of the scale
might if it should be thought necessary be
given to the European. In this case the persons
number returned should be 12 Mahometans
or Gentoos, and 15 Europeans.
In civil cases the majority should decide:

own verdict: not that of the hardiest and most
impassioned] In criminal cases two thirds might
in general be sufficient to convict: though perhaps
some variations in the number might be
grounded on the nature of the crime and the magnitude
of the punishment
With the regard to the power of
the exercise of it should not be only
but compelled: in order that in the discharge
of this invidious task the parties might have
to say they could not help it. The Mahomitan
or Gentoo should accordingly be compelled to strike off his
proportion
