Compensation Axioms

[It is the disposition of the Law that determines] It is
the Law that appoints the circumstances that in each
case shall be deemed constitutive of title in the
person whom they respect. But These circumstances
must be such as are in their nature notorious
and of proof.
But the ratio of one man's constitutional sensibility
to another man's constitutional sensibility, of one the
intensity of one man's present man's present demand to another man's present
demand. [of one man's fortune to another mans
fortune,] of the intensity of one mans expectation to that of another
man's expectation are facts that are in
their nature are hidden, and cannot be ascertained.
The Law therefore can not admitt them or any
of them into the number of circumstances constitutive
of title.
Qu why as to fortune The ratio of one man's fortune though +
+ not ascertainable without difficulty, nor at any rate to a degree minute exactness, is yet still however ascertainable, and to a degree of exactness suffi- tolerably sufficient for practical purposes. It can never not however be admitted among the circumstances constitutive of title for another reason.

The circumstances contstitutive of title must be such
as only one person or limited number of persons
can be in at a time: because in the of most the business only
objects of property as consumables &c it is only a
one person or limited set of persons can enjoy
them.
Therefore the comparative questions of their fortune
can not be taken into the numbers of consideration circumstances
constitutive of title: for if of two claimants
one was to have it to day because he was the poorer, for
the same reason a third should take it tomorrow,
as being poorer than either of them and so in
