Power over persons bears reference either to the
active faculty faculties of the person individual in question, or only
to his passive faculties. The motives by the application
of which power is exercised in relation
to the active faculty, is a motive of the by which an
influence is exercised or attempted endeavoured to be exercised
over the active faculty are with of the nature
of hope or other of the nature of fear: the prospect
of pleasure or the prospect of pain. Power in relation
to persons a person is scarcely termed spoken of as power over
such persons except in as far as it either has
forits subject the passive faculty of such person
or having for its subject the active faculty, it oft
has for its efficient cause the motive of fear, applicable
in such a degree as that obedience shown may
be considered as following of course.
Robotical or constitutional power The happiness of the whole community taken together
being according to the principle of utility the
only proper end of government, political or constitutional
power is under every modification of it
loaded with obligations: with obligation: the obligation of exercising
it in conformity subserviency to and with a view to the
promotion prosecution of that end. If the advantage attending
the possession of the power, whether it be power over upon
things
