Damage to reputation, damage in the way of
reputation, consists in the danger of the loss of
esteem of a diminution in the sense of esteem on
the part of persons in general in relation to the
person suffering the damage, that esteem valuable no
otherwise than as a source of good will, that good-will
valuable no otherwise than as a source of
numberless, though ambiguidated and unassignable
and contingent services. This stock defalcation made from the sum if given to happiness by Damage to reputation
is therefore ultimately resolvable in denier resort
into the danger a chance of the loss of an indefinite mass
of services.
Conditions in life are no otherwise articles of
value, have no otherwise an influence on the
sum of happiness, are no otherwise objects actual
or possible of the care and action operation of the
law than in as much far as they officiate as so
many ideal bases to which are attached certain such and
such modifications of property in things, or property in
the services of persons. The shock given to happiness
