Compensation. Ins:
3dly when the producing to danger to some, produce actual
pain in one or a few. In this case they
are in so far upon a footing with offences
of the 1st class: and in so far the party admitts of
compensation.
Offences of the 1st class therefore are those and those alone which
constantly admitt of Compensation.
By offences of the 3 last classes a kind of uneasiness
pain of Sympathy Resentment against the other offender produced without any other
pain. This resentment when it stands upon its
most legitimate foundation is a kind of pain of
sympathy resulting from the idea contemplation of the
[mischief likely to come to] supposed to be danger impending on the [public or other object community
of the injury]. But it has still more frequently
perhaps the bas foundation of it is neither so
warrantable nor so explicit. In Offences of the 3d
class it is often a party interest: in at other times those
of the 4th class it is a vague notion of turpitude
not grounded on nor regulated by [not brought into any subordination to] the principle
of Utility. This is more particularly apt to be the case
with offences against Religion; and will all the offences of the 4th class.
Be this as it may, this resentment uneasiness well or ill
grounded is a real mischief; and wherever it appears arises,
stands among the evil consequences of the offence.
This resentment is satisfied gratified in good measure and subsides
by the punishing of the offender. The persons
entertaining it received for the punishment a pleasure
(a pleasure to wit of the irascible appetite)
