Ins: Compensation.
which either in the whole or in part makes them amends
for the uneasiness they at suffer'd from the
observation of the offence: this pleasure then
stands among the good consequences of the punishment;
and is to be set against the pain which
the party punished is made to feel by it.
As to this Compensation of the branch vindictive kind
where [the resentment is not being founded on the Principle
of Utility] there is no demand for Punishment, it is
it can hardly be worth while ever to make it. The
gain would be never equal to the expence. For
1st It must be a great mass of pleasure of the
irascible appetite great in extent as well as magnitude
that can be equivalent to the pain necessary
to produce it
2. This whether intended or no for prevention,
would have the that effect of Prevention. And the things
offences in question modes of conduct for which the people were made to
suffer are by the supposition such as they have
a mind to do: that is such as produce pleasure.
This pleasure then whatever it be will be [annihilated] a part or the whole they
debarred by the punishment.
3. So when the Principle of Utility as once dissented refuted
there are no bounds to the actions that may be thus
reprobated: therefore 1 acts very important to happiness
may be taken into the number. 2d With as good reason Those which excite
disapprobation in some persons may excite approbation in other
