Compensation

security, they can not but must still frequently be exposed to suffer.

of quieting, if they are made to understand that in case
of their suffering, if the circumstances of the offender afford
him the means of making them compensation, they
will have it.

Besides The advantage just above mentioned which is an
advantage reaped by the Public, and extends to all
cases where damage an injury is sustained. There is another
which obtains in those cases only where the pec damage
being pecuniary be is converted to the profit of the
offender, and which tends to (encrease render enhance only the stock of
happiness [as between of] the two parties [him and the party
injured] taken together greater than it would be without.
The party injured by the loss of the thing in question
is the party who has title to retain and in case of loss to regain it: the offender is
one who has no such title. This being the supposition
the when it is gone in virtue of the offence to the offender the offender has by means of the offence
offender has got possession of it, the expectation which the party injured is in
of regaining it must be stronger than any the offender
has of retaining it. This must at least be the
case in general; howsoever it may happen otherwise by accident
