to that extent: if or much superior, it may be necessary
that he should be punished in a superior degree beyond.
In this case we are to observe that whatever comes
out of the pocket of the party offender is produces now so much
clear pain⊞ ⊞ and operates all of it in the way of punishment. The source from whence the injury arose was injury arose either from resentment
or negligence. If from resentment the pleasure
of the offence one may be also certain is by this time over: if from
negligence, there never was any pleasure belonging to
it, unless [the escape the escaping of] the trouble inconvenience that might have
been necessary to prevent the damage is to be placed
to that account, and that is commonly over at in an
instant.
The less opulent the circumstances are of the offender,
the more pain will a loss to a given amount produce
in him. On the other hand the less opulent
are the circumstances of the party injured, the more
pleasure will a gain to a given amount produce
in him.
Now the ratio of the circumstances of the parties to each other admitts
of three cases: 1st where they are equal: 2dly
where the author sufferer of the damage is the richer: 3dly where
the sufferer author of the damage is the richer.
First let them be supposed equal: and let us see upon
what footing the demand for compensation stands in
this case.
