which it appears to be the interest of the community to exact
such case of a man, is a business that would lead
us into details, and falls without the limits of this design. belongs to the doctrine of Offences.
In general the rule is we may lay it down as a rule is that
if the probable inconveniences which it would be to a every man to in
the situation in question take the requisite precaution be less than the mis probable
mischief of the damage, such precaution ought to be
exacted of him; if not, not.
When the damage is great, and the degree of suf negligence
is but small, it may very well happen
that the obligation to make amends may be a heavier
punishment than what (would be necessary) for the mere
purpose of prevention would appear necessary; and that
perhaps even although the damage were done wilfully. This
consideration however is not of itself a sufficient reason
for taking of any part of the burthen from easing
the Author of the damage in order to lay it on the
sufferer. For at the best the interest of the former
can only be at on a part with those of the latter; and
they are not upon a par so long as there is any a
chance of any thing to be gained by laying it on him
which there is not by laying it on another. Now
such a chance there will always be. For with regard
to punishment of all kinds and particularly pecuniary
punishment so it is, that the quantity can
