But even yet we are not at the bottom or say the rather
the top, of the desire of causes and effects. The benefit of certainty
on the part of the law rule of action depends on the notoriety upon
its notoriety, and thence upon its cognoscibility: the form on the other hand if
the mischief of uncognoscibility and non-notoriety that of uncertainty on the
part of the rule of action or what is more familiar to easily apprehended by the
conception conceptive faculty that of security on the part of the people
in respect of person, reputation, property and condition in life
on the part of the people is to a certain extent the a necessary result.
By the decisions of the three above supposed Courts, suppose
three mutually inconsistent dispositions made of the property
of an intestate as above. But suppose further (what
in such a case though not likely to be realized, is without
any difficulty conceivable) that of some of those conflicting decisions
the knowledge is generally spread among the people.
Suppose it (for thus for conception may go and
without difficulty) suppose the knowledge of such respective
decision confined within the breasts of the individuals individually
affected by it. In this case, the mischief of misdecision
whatever it consist of that and is whichever of the three
co-repugnant decisions be considered as the right one, this
mischief though by the supposition the subject of decision
is the matter of law, is as much confined as in the former
were where the subject of decision was the matter of fact.
