Delay, superabundant delayDelay is either necessary or superabundant.
Of the cause of necessary delay a view is given in the
annexed Table.
Superabundant delay may have its root in any one
or more of three distinguishable quarters; – the system – the parties,
or the Judge.
As to the System, of whatever quantity of superfluous delay it may at
any time happen to be clogged with, the main cause
has already been brought over and over again to view: the
sinister interest of the Judges men of law by which that system has been
successively formed and developed in the station of Judges.

question as well as in all its other branches, the system
a quantity of potential superabundant delay is furnished by the system
itself: of this potential quantity, a one portion is altogether
inevitable, not incapable of being saved by the united virtues
and exertions of all persons concerned, parties on both sides,
professional representatives of parties, judges and other
official ministers of justice.
Of As to that portion of superabundant delay, which, not being, under the existing system
unavoidable and necessary, takes has its in the voluntary exertion of persons as above, so far as it is the work of a
party on either side, it will the result consist of so much
of the potential part of the system, brought by his industry
into act.
