Without any blemish in the most part, delay, when springing
as of the conduct of the Judge, may have its root in the
intellectual part of his frame. He would decide, if he
knew how, but he knows not how. The grounds of materials for decision
can not find their way into his conception: conceiving them,
he feels himself unable to form any estimable
satisfaction to himself, of their separate form: of considerations
on both on the two opposite sides having presented themselves, and taken conjunct joint
possession of his mind, he feels himself unable as so to
weigh them against each other, as to determine on which
side the preponderancy is.
