But (says somebody) under all this sollicitation for putting
the decision on the matter of fact under one course of revision,
and the decision of in the matter of law under some
a much different course of revision, and thus to in which is included ousting
Juries of the cognizance of the matter of law, how do you is it
reconcilable
reconcile it either with actual practice, or with the best
received
what is at least generally regarded as the best
and most constitutional opinion in regard to the authority
of Juries? In all criminal cases, are they not de
facto judges of law as well as fact? in the case of libels
in particular does exists there not a State of no more
than 13 years standing made for the express of purpose of
declaring them so?

To this my answer is as follows:

1. The question in Scotland and Scotland alone is the
subject of the question on the carpet. In regard to Scotland
the direct object so far as England is concerned is not what is actually the practice there, but
of whatsoever is in practice there, what, if any thing is
most fit fittest to be adopted, as being most conducive to the ends
of justice.
