4. In regard to the subject of libels in particular, the
it important in my view is the maintenance of this power in the hands of
the a Jury that had it not been t in their hands whatever
is most valuable and most peculiar in the constitution of
those realms would long ago have been destroyed, or rather
would never have been in existence: and that the doctrines
uniformity as far as I understand right maintained by English Judges are would have carried
uniformity into practice be compleatly distinctive of the faculty of
canvassing the propriety of public measures: and
that the practice of the Star Chamber in their head would be a very
beneficial substitute for what had it depended in the
Judges would have been the practice of the Kings Bench.
