A circumstance that contributes to render still more apparent
the inability of any such change is – that in
virtue of the much greater extent of the supreme judicial
power possessed and exercised by the House of Lords, the
superior branches of supreme judicial power possessed and
exercised by the King are not as compleatly supreme
as the one exercised by the House of Lords.

On case of alledged malversation on the part of any
of the Kings delegat individuals acting on any occasion
as King's delegates in either branch of his judicial authority,
no doubt but that, at the prosecution of the House
of Lords Commons it would be in the power of the House of Lords
to inflict such punishment as should to them seen
real: whereas neither neither without nor with any
demonstration made by the House of Commons as it
in the power of the King to punish any such alledged
malversation on the part of any member of the House
or Lords in respect of the exercise of the judicial power
of the House of Lords.

Another The exercise of another modification made as branch of
judicial authority with reference to these same two corners
of the field of judicature, belongs also without dispute,
to the House of Lords as well as to the co-ordinate branch
assembly of the legislature: and that is the inquisitorial
branch, in virtue of which it the faculty of
obtaining such information as it thinks fit of whatsoever all proceedings
as done by them as by any other Courts of justice.
