3. The immediate cause seems to be discoverable in this
circumstance. The only way in which the attention
of the supreme superintending authority has commonly been called to
instances of supposed alledged the decision or proceeding of a superordinate
Court has been the way of appeal: whether characterized
by that same word or by some other synonymous to it in
effect. The effect of an appeal is to draw point the attention
of the superintending authority to the particular decision appealed
from – to the particular suit in the course of which that decision was
pronounced: but beyond that individual suit or even so much as beyond the
particular decision of which the appeal complains on the occasion
of that suit, the attention thus called for and bestowed
on the part of the superintending authority has never
extended, but never at least received any extension
from this source.
