On the supposed love of justice — occasioned
by an article in the Scotsman of
Sunday 5 July 1829
By Love of justice is meant regard for
human happiness considered as promoted by
observance of mixed rules especially rules laid down by authority of Government:: but justice having
two different imports according as it is by the
civil or say non-penal branch of law, or by the penal
branch of law, that these rules are considered
as laid down, hence it is it that in correspondence
with this distinction, justice,
and the love of it require two very different
descriptions; nor is there any one description
that can with propriety be applied
to both. in both case.
In matters of civil law, justice consists
in adherence to or in observance of, the non-disappointment
principle; by observing on all occasions
that line of conduct by which to expectation
of the enjoyment of that article belonging
to the lists of the several objects of general
desires which is in question either no disappointment
whatsoever or if some there it cannot
but be produced the minimum of disappointment
that can be produced. So much for justice
according to the import given to the
word in the sort of case called a civil case.
