S.1. p.5. 29 whether
it will not be
said that the use
of administering
the oath is to overawe
the witness not
to under the idea
of exercising a power
over the Almighty.
But the answer to
this is, that this
will be known to
the witness, or at
least to most witnesses,
and that they
awe they would
feel would be the
same without as
with the assistance
of the ceremony of
the oath.
A proof that a
power is considered as exercised
over the will of the
Almighty by the
performance of the
ceremony of the oath
is the number of
instances in which
the mendacity licence
is allowed to be &
is supposed to be
exercised with impunity.
S.6. p.12. Parliaments
impotency
in respect of mendacity
tracked
insisted upon
ante 12.
There is very
little difference
between the employment
in judicature
of the ceremony of
an oath or of
ordeal or of the
ceremony of an oath
- there being precisely
reason to expect
the special interference
of the Almighty
in the one case as
in the other.
For the purposes of
judication (S. .)
Oath is spoken of
as inefficient, yet
for as a cementing
the union of malefactors
it is spoken
of as highly efficient.
(S,8.)
It is perhaps an
account of the reputation
the ceremony
of an oath requires
by being observed to
be used on so solemn
an occasion as a
judicial one, that
it acquires the binding
force it possesses
& thence becomes
capable of being
used as a means
for sanctioning crimes
(S.8. p.3)
S.13. 27 whether its
antichristianity
ought not to stand
foremost, that being
likely to prove in
the eyes of many people
the principal objection
to it.
