Moral and proper in in punishment

1 Per Paley. Policy of English law to sweep all into a net & then make selections for punishment
"The law of England", (continues the Reverend Doctor) is constructed upon a different
"and a better policy. By the numbers of statutes
"creating capital offences, it sweeps into the net every
"crime, which under any possible circumstances may
"merit the punishment of death - + + Each statute specifies itself the very circumstances in which the supposed new demand for death is grounded. but when the execution
of this sentence comes to be deliberated upon, + + without expressible reasons
"a small proportion of each class is singled out, the
"general character, or the peculiar aggravations of whose
"crimes, render them fit examples of public justice".

Thus far again the Reverend Doctor. So many
have so many errors: and every error mischievous.

2 Erroniousness & mis & mischievousness of this doctrine 1. In 9 out of 10 cases it gives the King a dispensing power
1. The law of England indeed! forsooth. Thus In this time the law, but in another According
to his own account of the matter, in nine instances
out of ten, a power - a dispensing power exercised by the King
over the law: and such an exercise of dispensing
power eulogized by under the name policy - "the better" of them
his only policies he knew of by him under that namein a word the best policy -
and of all laws [this dispensing power] the policy of the
line of England!

Will but pardon (says somebody) you yourself approve: -
you yourself approved but now of pardon - and
having approved it under one name, is it for you
to turn short round and condemn it under another?
