Suppose indeed a choice of decisions following one
another and carried to such a length as to have driven
out the rule which itself, according in proportion to the extract
assumed unbraced by it, taken through the authority of the only
genuine sort of law genuine law - the written & statute law and to the same extent drawn
out justice - here indeed on this supposition the mischief of the infraction and so rule after rule till at last in this narrow corrupt principle the principle of nullification were had been consigned in toto to that abhorence infamy with which should ever proper bear undisputed sway it will be entered
could have waned vanished, and the benefit produced by it would remain
pure. Now might it to be overlooked, that, by the
infraction of a rule of judicial procedure, by which the th
disposition of the substantive or main branch of the law
is overthrown and a contempt put upon the authority of the only legitimate legislator, whatsoever mischief
may in manner above mentioned be produced, is neither equal in degree was altogether the same in
kind with the mischief produced by an infraction
of the equally manifest of an instant playing as above to the
main body of the law, especially if of that point of it

one usurption made by the lawful sovereign or even
by another usurption upon a first usurper. The mischief,
if not reduced 0 would in this case be at any rate
reduced to a comparatively small quantity:- why?
because it follows not that a Judge by whom disobedience
is paid to the usurped power of the predecessors to no other
effect than the paying obedience to their acknowledged sovereign,
would on another occasion manifest the same contempt
towards the only genuine sort which he has been manifesting towards
spurious laws.
