of things is no other than the present,
with only this difference viz That the laws
as enacted by the legislature would in
the State supposed instead of being dispensed
with or disobeyed in nine instances
out of ten be obeyed and executed in
every instance.
To me I must confess in the part point of
the public compassion there can be no
great danger nor any great hope of any
such want of endurance. Capital punishments
denounced in such abundance
is, in this behalf, the State of things, the
people at large including the very few
who ever care or think about the matter
were born under and are used to.
With them, as with the Reverend Doctor,
bating the blast of some momentary and
casual interest passion or caprice, practice
is the only proper or intelligible standard
of right and wrong. With them as with
him and Blackstone so long as every
thing is as it is wont to be every thing
