them wont to be expressed? Here then,
in this page it seems that the circumstances
in question viz the circumstances on which
the propriety or impropriety of inflicting
capital punishment turns are completely
capable of being expressed; while in the
next preceding page but one these same
circumstances were so decidedly and
inseparably circumstances "which how ever
"easy to perceive", "it is impossible to
"enumerate or define".

In it must be admitted still
remains to him viz the expressed by
the words "or to ascertain however with
"that exactness which is requisite in legal
"description" But the exactness this requires
for a legal purpose what is it but the
exactness required for any practical purpose.
Be the problem what it will, the will of
any person or persons can upon no other terms
