"Answered"? Yes indeed: but how?
in a certain sort, still yes: but in what
sort. These laws never meant to be carried
into indiscriminate execution? No certainly
nor so long as any such power as the
power of pardon is known to exist any
other laws of the penal class that can be
named. But in this observation what is
there that applies with any exclusive or
peculiar force to the particular class of
penal laws here in question — over those,
to wit by which death is appointed for
a punishment.

As to any meaning applying more
particularly or exclusively to these laws,
if that be meant by the Reverend Doctor
as it seems to have been meant by him
to be insinuated the same observation that
