he had undertaken to prove — admitting
the existence of lenity as a quality belonging
to those laws, what, in conclusion, he sets
himself to make out is that though it
does exist it does not exist in any such
degree as can justly be termed excessive.
Quere how to make sure of this? Answer
by supposing that in saying vindicate he
meant prove.
Two other objects which on this same
occasion, appear to have stood confounded
in his mind are the same two objects which
at the outset it had been necessary for him
to distinguish and which at that period
he accordingly did distinguish the two
antagonising parts (I mean) whiche he
considered his supposed system of policy
as composed viz the laws themselves viz the
Statutes themselves and the mode in which
they were administered; administered i.e.
in nine instances out of ten defeated by
those whose province it was according to the
constitution to execute them. Here these two
