the practice has just as much of the
one quality in it as the other was an all
pervading disease, manufactured by his
learned bretheren and forced by them
into every part of the legal system,
civil as well as criminal, as well that
part with which punishment had not
any thing to do in any shape as that
part which prescribed death for punishment.
Was it a secret to him that the
common sense of mankind rises up
now and then in judgement against
the iniquity, the eye of the legislator
now and then half opened itself for the
purpose of looking at and proscribing
it and that accordingly in the civil
branch it as often received a weak and
insufficient check — but that the creators
and preservers of the corrupt system
had influence enough to ward off
altogether the application of the remedy
from the whole of the criminal branch —
thus for all these enormities — for all this folly
