1. If there were no other means of saving
delinquents from the punishment of death,
than the giving encouragement on the part
of Jurymen to perjury, the encouragement
thus given whether useful upon the whole
or not would not be absolutely devoid
of use. But on the particular occasion
in question, as on all others a much more
simple as well as efficacious mode of
punishment is in mens power viz the ceasing
to employ it.

2. If on the part of the legislator there
were no other means of avoiding the use
of the punishment of death than the conniving
at the disobedience and immorality
practised by the Judge, in the subornation
or perjury on the part of Jurymen, the
mischief thus done, whether productive of
real advantage or no upon the whole would
