On this supposition, indeed, the mischief of
the infraction would have vanished, and
the benefit produced by it would remain
pure. Nor ought it to be overlooked
that by the infraction of a rule of judicial
procedure by which the position
of the substantive or main branch of
the law is overthrown and a contempt
put upon the authority of the only legitimate
legislator, whatsoever mischief
may in manner above mentioned be
produced, by an infraction equally
manifest if an article belonging as
above to the main body of the law,
